UPCOMING CHANGES FOR FERTILIZER APPLICATORS IN VIRGINIA In 2008 the Virginia General Assembly amended the Commercial Fertilizer Law (Code of Virginia 3.2-3600 et seq.) mandating the establishment of regulations to certify the competency of those fertilizer applicators who apply fertilizer to nonagricultural lands. The 2011 session of the General Assembly further amended the Commercial Fertilizer Law establishing reporting requirements for fertilizer applicators who apply lawn fertilizer to more than 100 acres of nonagricultural lands annually. The intent of these changes is to reduce the flow of excess nutrients into rivers, streams, and lakes of the Commonwealth through the establishment of fertilizer application training, certification, and recordkeeping requirements. Important Dates: - Fertilizer applicators will be required to complete fertilizer applicator certification training prior to February 1, 2013. - Fertilizer applicators will be required to submit an annual report to VDACS. This annual report must include the total acreage or square footage, by zip code, of the nonagricultural land receiving fertilizer in the preceding calendar year. Submission of the initial report for fertilizer applications to nonagricultural lands will be required by February 1, 2014 for fertilizer applications during the 2013 calendar year.
